Introduction

This GoLite Mobile Consumer Agreement (“Agreement”) sets forth the terms and conditions that apply to your purchase of services from GoLite Mobile. By using the services, you agree to the terms and conditions in this Agreement and any updates that may be made. If you do not agree, do not purchase or use our products.     These documents may apply to your purchase and use of our products and services.

Definitions

  • Account: Refers to usage within a billing cycle for a predetermined set of international destinations purchased through GoLite Mobile and/or a prepaid balance linked to your phone number.
  • Client: Refers to GoLite Mobile Inc., its distributors, or authorized retailers.
  • Service: The International Long Distance (ILD) service provided by GoLite Mobile, allowing calls to international destinations.
  • Consumer (“You,” “Your”): The end-user of the service and account holder.
  • This Agreement, including any posted service descriptions, disclosures, and terms, applies to all consumers.

Charges and Payment

Price, Feature, and Rate Changes

We may change the pricing, features, or availability of the service at any time. Such changes will take effect once posted on our website. Rates for calls made to available destinations are subject to change without prior notice.
  • PAYG ILD Service expires 30 days after purchase and is billed in one-minute increments.
  • Unlimited ILD Service:
For personal, non-commercial use only.
  • “Unlimited” means no per-minute charge but is subject to reasonable use.
  • Each account may call up to 10 unique destinations per month.
  • Call destination limits reset monthly upon renewal.
  • GoLite Mobile may monitor and limit excessive or unreasonable usage.

Refunds & Billing Disputes

  • Refunds: Prepaid services are non-refundable, except in cases of unauthorized charges, service failures, or billing errors.
  • Billing Disputes: If you believe you were incorrectly charged, contact [email protected]. within 30 days of the charge date. Failure to dispute within this period waives your right to a refund or adjustment.

Suspending or Canceling the Service

We reserve the right to suspend, restrict, or terminate your account without prior notice if:
  • We suspect fraudulent or unlawful activity.
  • Your usage is inconsistent with reasonable personal use.
  • You violate any laws, rules, or regulations.
If your account is suspended or terminated, remaining balances will not be refunded.

Service Availability & Network Reliability

  • We do not guarantee uninterrupted or error-free service.
  • Service may be temporarily unavailable due to maintenance, network issues, or external factors.
  • We are not liable for service interruptions but will make reasonable efforts to restore connectivity.

Privacy & Data Protection

  • GoLite Mobile collects, stores, and processes your personal data in compliance with U.S. privacy laws.
  • Your data may be used for service improvements, fraud prevention, and customer support.
  • We do not sell your personal data to third parties.

Intellectual Property

All GoLite Mobile trademarks, service marks, logos, and intellectual property belong to their respective owners. You have no right to use these marks unless explicitly authorized.

Indemnification

You agree to indemnify and hold harmless GoLite Mobile Inc. and its affiliates from any claims arising from:
  • Your use of the service.
  • Misuse of the account.
  • Violation of this Agreement.

Limitations of Liability

We are not liable for any incidental, consequential, or punitive damages. This includes claims related to service failures, lost profits, or business disruptions. These limitations apply whether the claim is based on contract, tort, statute, fraud, or misrepresentation.

Dispute Resolution & Governing Law

  • Governing Law: This Agreement is governed by the laws of the State of California.
  • Dispute Resolution:
  • Disputes must first be addressed through Customer Support at [email protected].
  • If unresolved, disputes will be handled through binding arbitration in California, per the American Arbitration Association (AAA) rules.
  • You waive your right to a class-action lawsuit.

Changes to the Agreement

GoLite Mobile may update this Agreement at any time. Updated versions will be posted at www.golitemobile.com. To request a copy, email [email protected].
